IMPORTANT NOTICE
PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING THE WILDMETA APPLICATION, WEBSITE, OR ANY RELATED SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.
THE SERVICES ARE PROVIDED FOR INFORMATIONAL AND INTERFACE PURPOSES ONLY. WILDMETA DOES NOT PROVIDE INVESTMENT ADVICE, FINANCIAL SERVICES, OR BROKERAGE SERVICES.
SECTION 14 (DISPUTE RESOLUTION) CONTAINS PROVISIONS THAT GOVERN HOW DISPUTES BETWEEN YOU AND WILDMETA WILL BE RESOLVED, INCLUDING AN AGREEMENT TO ARBITRATE DISPUTES AND CLASS ACTION WAIVER. PLEASE READ SECTION 14 CAREFULLY.
SECTION 11 (RISK DISCLOSURES) CONTAINS IMPORTANT INFORMATION ABOUT THE RISKS ASSOCIATED WITH BLOCKCHAIN TECHNOLOGY AND DIGITAL ASSETS. BY USING THE SERVICES, YOU ACKNOWLEDGE AND ACCEPT THESE RISKS.
1.1 Agreement. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Trust Computing GmbH, a German limited liability company ("WildMeta," "we," "us," or "our"), governing your access to and use of the WildMeta application, website, and related services (collectively, the "Services").
1.2 Incorporation by Reference. These Terms incorporate by reference our Privacy Policy and any other policies or guidelines we may publish from time to time.
1.3 Updates. We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Services after such changes constitute your acceptance of the revised Terms.
1.4 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and WildMeta regarding the Services.
2. DEFINITIONS
"Digital Assets" means blockchain-based tokens, cryptocurrencies, and other digital assets that can be stored in or transferred through blockchain networks.
"Interface" means the WildMeta software application and website that enables users to interact with blockchain protocols.
"Services" means the WildMeta application, website, and all related software and services provided by WildMeta.
"Third-Party Protocols" means decentralized protocols, smart contracts, and blockchain networks that users may interact with through the Interface.
"User Wallet" means the digital wallet connected to the Services that is owned and controlled solely by the User.
"Account Abstraction Wallet" means the ERC-4337 compatible wallet infrastructure that facilitates user interactions with blockchain protocols.
3. DESCRIPTION OF SERVICES
3.1 Interface Services. WildMeta provides a software interface that enables users to:
Connect their existing digital wallets to blockchain protocols
View and interact with various decentralized applications (dApps)
Facilitate transactions through connected wallets
Access information about Digital Assets and blockchain protocols
3.2 Non-Custodial Architecture. The Services are purely non-custodial. WildMeta:
Does NOT take possession, custody, or control of any Digital Assets
Does NOT store private keys or user credentials
Does NOT have access to user funds
Does NOT execute transactions on behalf of users
3.3 Account Abstraction Technology. The Services utilize ERC-4337 account abstraction technology to enhance user experience while maintaining complete user control over their assets.
3.4 No Financial Services. WildMeta is NOT:
A financial institution, bank, or money services business
A cryptocurrency exchange or trading platform
A broker, dealer, or investment advisor
A custodian or fiduciary
4. USER ELIGIBILITY AND RESTRICTIONS
4.1 Age Requirement. You must be at least 18 years old to use the Services.
4.2 Legal Capacity. You must have the legal capacity to enter into this agreement in your jurisdiction.
4.3 Geographic Restrictions. The Services are not available to residents of or persons located in:
Any jurisdiction where use would violate local laws
Countries subject to comprehensive U.S. or EU sanctions
Jurisdictions where WildMeta is prohibited from operating
4.4 Compliance. You are solely responsible for ensuring your use of the Services complies with all applicable laws and regulations in your jurisdiction.
5. USER RESPONSIBILITIES
5.1 Wallet Security. You are solely responsible for:
Maintaining the security of your connected Wallet
Protecting your private keys, seed phrases, and credentials
All activities conducted through your connected wallet
5.2 Transaction Verification. Before approving any transaction, you must:
Verify all transaction details including amounts, addresses, and gas fees
Understand the risks associated with the transaction
Confirm you have sufficient understanding of the protocol you're interacting with
5.3 Risk Acknowledgment. You acknowledge and accept all risks associated with:
Blockchain technology and Digital Assets
Smart contract vulnerabilities
Market volatility
Potential loss of funds
5.4 Taxes and Reporting. You are solely responsible for determining and paying any taxes that may apply to your use of Digital Assets and blockchain transactions.
5.5 Prohibited Activities. You agree not to:
Use the Services for any illegal activities
Attempt to gain unauthorized access to the Services
Interfere with the proper functioning of the Services
Violate any applicable laws or regulations
Engage in market manipulation or fraudulent activities
Use the Services to launder money or finance terrorism
Circumvent any technical limitations of the Services
6. INTELLECTUAL PROPERTY
6.1 Ownership. WildMeta retains all rights, title, and interest in the Services, including all intellectual property rights.
6.2 License. Subject to these Terms, WildMeta grants you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes.
6.3 Restrictions. You may not:
Copy, modify, or distribute the Services
Reverse engineer or attempt to derive source code
Use the Services for commercial purposes without authorization
Remove or modify any proprietary notices
7. THIRD-PARTY SERVICES
7.1 Third-Party Protocols. The Services may interact with third-party protocols, smart contracts, and blockchain networks. WildMeta:
Does not control or endorse these third-party services
Is not responsible for their availability, security, or functionality
Makes no warranties regarding third-party services
7.2 User Responsibility. You are solely responsible for:
Understanding the risks of third-party protocols
Verifying the legitimacy of smart contracts
Your interactions with third-party services
8. FEES AND PAYMENTS
8.1 Service Fees. WildMeta may charge fees for certain services. Any fees will be clearly disclosed before you incur them.
8.2 Network Fees. You are responsible for all blockchain network fees (gas fees) associated with your transactions.
8.3 Third-Party Fees. You are responsible for any fees charged by third-party services you interact with.
9. PRIVACY AND DATA PROTECTION
9.1 Privacy Policy. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms.
9.2 Data Security. While we implement reasonable security measures, you acknowledge that no system is completely secure.
10. RISK DISCLOSURES AND ASSUMPTION OF RISK
BY USING THE SERVICES, YOU ACKNOWLEDGE AND ACCEPT THE FOLLOWING RISKS:
10.1 Blockchain Technology Risks:
Blockchain networks may experience downtime, congestion, or attacks
Smart contracts may contain bugs or vulnerabilities
Transactions are irreversible once confirmed
Network upgrades may affect functionality
10.2 Digital Asset Risks:
Digital Assets are highly volatile and may lose value
Digital Assets may become worthless
Regulatory changes may affect Digital Assets
Liquidity may be limited for certain Digital Assets
10.3 Technical Risks:
The Services may experience downtime or technical issues
Account abstraction technology is experimental
Internet connectivity issues may affect access
Device security compromises may result in loss of funds
10.4 User Responsibility:
You are solely responsible for the security of your wallet
Loss of private keys may result in permanent loss of funds
You must understand the risks before using any protocol
No insurance covers losses from using the Services
10.5 Third-Party Protocol Risks:
Third-party protocols may fail or be exploited
Smart contract upgrades may affect functionality
Protocol governance decisions may be unfavorable
Economic attacks on protocols may result in losses
YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF THE SERVICES AND DIGITAL ASSETS.
11. DISCLAIMERS
10.1 As-Is Basis. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
10.2 No Warranties. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILDMETA DISCLAIMS ALL WARRANTIES, INCLUDING:
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
ACCURACY OR COMPLETENESS OF INFORMATION
UNINTERRUPTED OR ERROR-FREE SERVICE
SECURITY OR FREEDOM FROM VIRUSES
COMPATIBILITY WITH THIRD-PARTY PROTOCOLS
10.3 Investment Disclaimer. THE SERVICES ARE NOT INTENDED TO PROVIDE INVESTMENT ADVICE. DIGITAL ASSETS ARE HIGHLY RISKY. YOU SHOULD CONSULT WITH QUALIFIED PROFESSIONALS BEFORE MAKING INVESTMENT DECISIONS.
10.4 No Guarantee of Profits. WILDMETA MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT POTENTIAL PROFITS OR LOSSES FROM USING THE SERVICES.
12. LIMITATION OF LIABILITY
12.1 Exclusion of Damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILDMETA SHALL NOT BE LIABLE FOR:
ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, DATA, OR DIGITAL ASSETS
DAMAGES RESULTING FROM YOUR USE OF THE SERVICES
LOSSES FROM THIRD-PARTY PROTOCOL FAILURES
LOSSES FROM MARKET VOLATILITY
LOSSES FROM REGULATORY CHANGES
12.2 Liability Cap. IN NO EVENT SHALL WILDMETA'S TOTAL LIABILITY EXCEED €100 OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.
12.3 Essential Basis. THE LIMITATIONS IN THIS SECTION ARE FUNDAMENTAL ELEMENTS OF THE AGREEMENT BETWEEN YOU AND WILDMETA.
13. INDEMNIFICATION
You agree to indemnify and hold harmless WildMeta from any claims, damages, or expenses arising from:
Your use of the Services
Your violation of these Terms
Your violation of any applicable laws
Your interaction with third-party protocols
14. TERMINATION
14.1 Termination Rights. Either party may terminate this agreement at any time.
14.2 Effect of Termination. Upon termination:
Your right to use the Services ceases immediately
Provisions regarding liability, indemnification, and dispute resolution survive
15. DISPUTE RESOLUTION AND ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS IMPORTANT INFORMATION ABOUT HOW DISPUTES WILL BE RESOLVED.
15.1 Binding Arbitration. Except for disputes that qualify for small claims court, any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration rather than in court.
15.2 Arbitration Rules. Arbitration will be conducted under the rules of the German Institution of Arbitration (DIS) or another mutually agreed arbitration service.
15.3 Individual Disputes Only. YOU AND WILDMETA AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
15.4 Opt-Out Right. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms.
15.5 Governing Law. These Terms shall be governed by German law, excluding conflict of law principles.
15.6 Jurisdiction. For disputes not subject to arbitration, the competent courts in Munich, Germany shall have jurisdiction.
16. GENERAL PROVISIONS
16.1 Severability. If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
16.2 No Waiver. Failure to enforce any provision does not constitute a waiver of that provision.
16.3 Assignment. WildMeta may assign these Terms without notice. You may not assign these Terms without our written consent.
16.4 Force Majeure. WildMeta shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
